Va. AG's office: Gay Marriage Ban Unconstitutional 1/23/14
January 23, 2014
RICHMOND, Va. — The decision by Virginia's attorney general to join challenges of the state's constitutional ban on gay marriage is drawing sharply divided responses.
Attorneys representing couples challenging the ban are celebrating the decision by Attorney General Mark Herring, calling it an historic day for Virginia.
One attorney said "it's a nice day to be an American."
But the conservative Family Foundation of calls Herring's decision "disappointing and frightening."
Herring says he has concluded the marriage prohibition is unconstitutional. He's filing a brief Thursday in Norfolk outlining his opposition.
Four couples are challenging the state's 2006 adoption of the ban.
