Affidavit Reveals New Details on Death of Pecos Woman 01/17/14

Pecos - CBS 7 has obtained the arrest affidavits for Michael Pena, which gives us the first glimpse into what really happened that night. Pecos Police officials first responded to Kristina Lopez's apartment where her boyfriend had reported a suicide. However when investigators arrived to the scene they say it was clear that someone had tried to clean the mess up, and statements from Lopez’s daughter all points to one suspect.
The affidavit states bloodstains could be found smeared on the walls and floors of five different rooms inside Kristina Lopez’s apartment. Boyfriend Michael Pena is now the sole suspect of this case being charged with murder as well as tampering with or fabricating physical evidence.
“We have evidence to show that he changed the crime scene, or altered the crime scene to lead the investigators to believe that it was a suicide,” said Pecos Police Chief Clay McKinney.
However when questioned about that night Pena’s story changed three times. First he says that they did have an argument but it wasn’t serious. Then he says there was a fight that caused Lopez to lose a substantial amount of blood then later died in the bathroom. And in a final interview he said he was only defending himself and never stabbed Lopez.
But Pena wasn’t the only one present. Lopez’s five-year-old daughter has given a statement as well, saying Pena struck her mother on the head, and brought her into the bathroom where he cut her.
The results from Wednesday’s autopsy show that Lopez died from multiple stab wounds, found on the chest, buttocks and left leg.
“The physical evidence is speaking for Ms. Lopez now and telling her story,” said McKinney.
Pecos - More information is surfacing regarding the suspected murder of Pecos resident Kristina Lopez last Sunday. Since then her boyfriend Michael Pena has been arrested and charged with one count of murder and one count of tampering with or fabricating physical evidence.
According to the affidavit on January 12th, Pecos Police responded to Kristina Lopez’s apartment on a suicide call placed by her boyfriend where he stated his, quote “girlfriend did something dumb and was not breathing.” Upon arrival police thought anything but suicide, the affidavit states detectives smelled a strong stench of Bleach and found Lopez’s body deceased in the bathroom. During questioning Pena admitted to cleaning up prior to the arrival of Pecos Police officers.
The affidavit states blood was found in the master bedroom, kitchen, children’s room, bathroom, living room and front door. On the body there were stab wounds located on the left chest area, left buttocks and left leg.
A forensic interview was conducted in Midland with Pena’s oldest child who was at the home that night. In her statement she said her mother told Pena to stop and saw Pena go into the kitchen and retrieve a knife.
