Condemned Inmate Loses Appeal in Double Slaying 9/25/13
HOUSTON - The Texas Court of Criminal Appeals is agreeing with a lower court in rejecting an appeal from a Houston man on death row for a robbery where a police officer was among two people killed.
Elijah Dwayne Joubert (zho-BEHR') was one of two men condemned for the 2003 holdup of a check-cashing store where clerk Alfredia Jones and 45-year-old Houston officer Charles Clark were fatally shot.
Evidence showed Joubert killed Jones and a partner, Alfred Dewayne Brown, shot Clark. Clark was responding to a robbery call.
Joubert raised 17 points of error from his 2004 trial. His trial court reviewed the claims at an evidentiary hearing and rejected them. The appeals court Wednesday agreed with that finding.
Brown also is on death row. Neither man has an execution date.
