Feds Going First in Rio Grande Valley Slaying Case 7/21/13

MCALLEN, Texas (AP) - A state capital murder trial for three Rio Grande Valley men accused in a fatal home break-in is on hold while federal prosecutors pursue a trial on additional charges.
The three men -Juan Antonio Moreno, 29, Jess Joe Mata, 20, and Alberto Vela, 28 - face trial likely next month in federal court on drug conspiracy and weapon charges.
They're accused of breaking in a home near Edinburg last year to steal about 300 pounds of marijuana but apparently hit the wrong home.
The Monitor of McAllen reports court records show as one of the residents, Eric Serna, struggled with the intruder, Serna's father, Victor, grabbed a gun and ran to help his son. The elder Serna then was shot in the head by a second intruder.
