Lawsuit Part of Settlement Process between State and Big Spring Veteran Nursing Home 2/26/13

Big Spring - A settlement is in the works between the state of Texas and Sears Methodist Retirement System, owners of Lamun-Lusk-Sanchez Texas Veterans Nursing Home in Big Spring.
Representatives with Sears Methodist say an incident report was filed last year questioning how a LVN followed the physician notification policy and resident care plans after an 87-year-old resident died from diabetes complications.
"This is not an uncommon part of how these incidents reported get resolved. It's part of the regular procedure," Jim Suydam, with Texas Veterans Land Board, spokesman for Sears Methodist said.
Suydam says the state and Department of Aging and Disabilities work together on these incident reports before a settlement is reached. He says since they do serve our veterans, they are held to a higher standard by the state.
"We aim to give these veterans the best care we can because they've earned it," Suydam said. "We have a higher duty to be able to provide a service thats going to be scrutinzed. We take it seriously."
My family has a personal connection to the nursing home. My grandfather lived there for several years and unlike reported incident, my family had a different experience.
"She took the time to make sure he had a haircut and that means alot. They care about them. It still makes me emotional to think about," Charlottle Guinn, my mother said.
Sears Methodist says they take each and every incident report seriously and work to improve the quality of care they provide.
CBS 7 did work to find the resident's family that was mentioned in the report. Our efforts as of news time were not successful.
