Texan Convicted in Wife's Death Seeks New Trial 9/12/12

HOUSTON (AP) - A Houston-area former high school football coach convicted of killing his pregnant wife is asking for a new trial based on a potential new witness who has come forward.

David Temple in 2007 was sentenced to life in prison for the 1999 shooting death of his wife, Belinda.

Temple's attorneys filed a motion Monday that points to a new witness. They say the witness - identified only as "John Doe" - heard an alternate suspect admit to burglarizing the couple's home in Katy and firing a shotgun.

The motion also says prosecutors during the trial withheld evidence that points to the alternate suspect.

Kelly Siegler, who prosecuted the case, declined immediate comment Wednesday.

A judge in Houston has scheduled an Oct. 1 hearing on the motion.
